What does OSHA require for construction site video documentation?

OSHA does not require video surveillance on construction sites. 29 CFR 1926.20(b)(2) requires employers to run safety programs that include frequent and regular inspections of job sites, materials, and equipment, and 29 CFR 1904 requires recording and reporting of work-related injuries and illnesses. Video documentation of safety protocols and timestamped incident records support both obligations without satisfying either on its own.

Yes. Some states operate their own OSHA-approved plans with standards that can exceed the federal baseline. California’s Cal/OSHA, governed by Title 8 of the California Code of Regulations, is generally the most stringent, with additional training, hazard communication, and enforcement requirements for construction. States without an approved plan, including Texas, fall under federal OSHA directly. Confirm which framework applies to your site.

There is no single federal rule. The Electronic Communications Privacy Act and the Stored Communications Act permit monitoring for legitimate business purposes while restricting interception of private communications. Some states, including New York, require notice to employees. In California, the Consumer Privacy Act applies data minimization, so monitoring must be necessary and proportionate. Clear written notice of what is monitored and why is the common baseline.

The OHSA and Ontario Regulation 213/91 govern construction projects. A Notice of Project is required where labour and material costs exceed $50,000 or the work meets other thresholds in section 6. Constructors must establish and post written emergency procedures, ensure every worker has ready access to two-way communication in an emergency, and keep required records for at least one year after the project finishes.

British Columbia’s Workers Compensation Act and OHS Regulation set two separate obligations. Employers file WorkSafeBC Form 7 within 72 hours where a worker missed time or needed treatment beyond first aid, with immediate phone notification for serious incidents. A preliminary investigation report is due within 48 hours and a full report within 30 days. Investigation records are generally kept at least three years.

Alberta’s framework has three layers: the OHS Act, the OHS Regulation, and the OHS Code. A prime contractor is required on every construction site with two or more employers. Serious incidents, including fatalities, hospital admissions, and the collapse of a crane or of any component of a building or structure, must be reported to OHS as soon as possible. The scene must not be disturbed.

Under Quebec’s Act respecting occupational health and safety, the employer must inform the CNESST as quickly as possible, and within 24 hours, of incidents meeting the thresholds in section 62. The scene must be preserved until the CNESST authorizes changes. Employers also carry duties covering workers’ psychological integrity alongside physical safety, and certain OHS records carry retention periods of up to five years.

It depends on where the site is. Only Alberta, British Columbia, and Quebec have private-sector privacy laws deemed substantially similar to PIPEDA, which otherwise governs federally regulated employers. Quebec’s Law 25 requires monitoring to have a legitimate purpose, be proportionate and minimally intrusive, and requires workers to be informed of the type, purpose, and timing of monitoring. Ontario employers with 25 or more employees must maintain a written electronic monitoring policy.

Requirements are set by the carrier and the policy, not by regulation. Builders risk and course of construction policies commonly ask about perimeter control, lighting, access control, and whether the site is monitored, and monitored sites can qualify for reduced premiums. Ask your broker what your specific policy requires before you finalise your site security plan.
